GENERAL TERMS AND CONDITIONS OF SALE

Article 1: Scope of the General Terms and Conditions of Sale

These terms and conditions govern the sale of holidays by Camping des Bains. They constitute the entire contractual relationship between the campsite and its customers. All other conditions are excluded, unless modified and accepted by the customer at the time of booking.
The Campsite reserves the right to modify its general conditions at any time. However, the version applicable to the customer is the one accepted at the time of booking.

Article 2: Acceptance of the General Terms and Conditions of Sale

The customer is deemed to accept these General Terms and Conditions of Sale without reservation, in accordance with article 1126 of the French Civil Code. When booking online or by receiving confirmation of the booking by e-mail, the customer expresses their specific, free and informed consent, in particular with regard to the use of personal data. This consent is valid for the customer and for all persons taking part in the holiday. The General Terms and Conditions of Sale are also available on the campsite website and at Reception.

Article 3: Booking

3.1 Booking conditions Booking methods: Customers may book online, by telephone or directly at the campsite.

Validation of the reservation: All reservation requests are considered definitive once they have been accepted by the Campsite. The Campsite reserves the right to refuse a booking depending on availability or any other circumstance that may affect the planned stay. Acceptance of the reservation is confirmed by sending a confirmation by e-mail, post or hand delivery.
To validate a booking, the customer must make a payment comprising:
- A deposit of 30% of the total cost of the holiday.
The online provision of the customer's bank card number and the final validation of the order constitute proof of the customer's agreement and render payable the sums due in respect of the reservation, as well as all the operations carried out.
Capacity and participants in the holiday: Reservations are made by name. The customer must be over 18 years of age and take part in the holiday booked.
It must also legally provide the number and age of all participants, including minors and newborns. The Campsite reserves the right to refuse any unregistered person at the time of booking. Any incorrect information may result in the cancellation of the stay. Since the reservation is personal, it cannot be transferred or sublet, in whole or in part, without the prior written consent of the Campsite. For safety and insurance reasons, the maximum number of occupants per type of accommodation/pitch, as indicated on the website, must be respected. The Campsite will refuse any person exceeding this capacity, except for potential visitors invited by the client for the day.
Groups: The Campsite offers family-oriented stays, with accommodations specifically designed for this purpose. The Campsite reserves the right to refuse any reservation that does not comply with the capacity and accommodation offered.
The Campsite considers any reservation of 5 rental accommodations/pitches or more, made by the same individual or legal entities, or by different individuals who know each other and travel together for the same reasons, on the same dates and at the same Campsite, as a group. Group reservation requests must be sent by email to info@campinglesbains.com or by phone at 03 86 30 73 44 (local call rates according to your operator), specifying that it is a group reservation request. The Campsite reserves the right to study the request before accepting or refusing it.

3.2 Important Information Minors' Admission: For obvious safety reasons (swimming pool, Campsite evacuation in case of an alert, etc.) and health reasons (hospitalization, etc.), unaccompanied minors, in accordance with Article 389 of the Civil Code, are not allowed. Furthermore, according to Decree 2002-883 of May 3, 2002, the Campsite is not authorized to accommodate unaccompanied minors under the age of 18, outside their family home. Minors accompanied by their legal representatives are under their full responsibility and must not be left unattended within the Campsite premises, including the water park.
Non-contractual nature of communication materials: All documents other than these General Sales Conditions, such as catalogs, brochures, advertisements, notices, have informative and indicative value but are not contractual. Plans and photos of rental accommodations are provided for illustrative purposes. The layout and characteristics of the rooms may vary from one model to another. It is recommended to consult the detailed description of the facilities available on the accommodation section of the Campsite's website to know the exact composition of each rental accommodation. A description is also available inside each rental accommodation. For any questions, the Campsite is at your disposal at 03 86 30 73 44 (local call rates according to your operator).
Campsite facilities and activities: It is possible that certain activities and facilities offered by the Campsite (directly or through providers), such as Wi-Fi or elements mentioned in the description, may be removed or unavailable, especially due to weather conditions or force majeure, or they may not function, particularly in the early and late seasons. The Campsite disclaims any responsibility in this regard. The Campsite will inform the client of any ongoing construction work, incidents, or developments during their stay.

Article 4. Prices

The applicable prices are those indicated at the time of reservation by phone, online, or at the Campsite. They are subject to change during the season and are stated in euros including VAT. Any subsequent modification of the applicable VAT rate, occurring between the moment the rates were determined and the invoicing of the stay, will result in a proportional modification of the total price including VAT, which the Client accepts without reservation. The price includes: • The rental of the pitch or accommodation as defined in the website; • Water gas consumption and electricity; • Access to the Campsite, its facilities/amenities, and its entertainment (except for the list below) as defined in the brochure and websites; • Parking space for one car per rental (the parking space may not necessarily be on the rented pitch).
The price does not include: Various taxes; • Paid activities offered by the Campsite to be paid on-site; • Additional supplements such as cleaning fees; • Security deposits; • Cancellation/interruption insurance; • Optional amenities ( etc.).
Article 5. Terms and Methods of Payment
5.1 Payment Terms
• For reservations made more than 30 days before the start of the stay, a deposit of 30% of the total amount of the stay must be paid at the time of reservation. The balance must be paid no later than 15 days before the start date of the stay.
• For reservations made less than 30 days before the start of the stay, full payment must be made at the time of reservation.
In the event of non-payment on the agreed-upon date, the Campsite has the right to consider the reservation canceled and retain any amounts already paid. For groups, payment terms are specified at the time of reservation.
5.2 Methods of Payment
The accepted methods of payment for the deposit and/or the total stay vary depending on the payment date: • If the payment is made at least 30 days before the arrival date: it can be made by credit card, bank transfer, holiday vouchers (sent by registered mail with acknowledgment of receipt), and check in euros (sent by registered mail with acknowledgment of receipt). • If the payment is made between 29 and 15 days before the arrival date: it can be made by credit card, bank transfer, holiday vouchers, and check in euros (sent by registered mail with acknowledgment of receipt).
• If payment is made between 14 days and the day before arrival: it can only be made by credit card or bank transfer. • For on-site payments: the client can settle the balance by credit card, cash, and checks in euros.
5.3 Clarifications on Credit Card Payments
Accepted credit cards are those from the Carte Bleue networks (Visa, Eurocard/Mastercard). American Express is not accepted. The transaction is immediately debited from the client's credit card after verification of the card data. In accordance with Article L.132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing the information related to their credit card, whether online or by phone, the client authorizes the Campsite to debit their credit card for the amount of the deposit or the total stay. For this purpose, the client confirms that they are the holder of the credit card to be debited and that the name on their credit card is indeed theirs.
Article 6. Services not included in the price
6.1. Tourist tax
The tourist tax is collected on behalf of the municipalities and must be paid at the campsite. The amount, determined per person per day, varies depending on the destinations and may be subject to change during the year.
6.2. Paid activities offered by the Campsite to be paid on-site
Certain activities offered by the Campsite or its providers are optional and require payment. It should be noted that access to the Campsite's swimming pool is not a paid activity.
6.3. Cleaning fees
The client may request that the departure cleaning be done by the Campsite for a cleaning fee, the amount of which varies depending on the range of the mobile home. Cleaning fees do not include dishwashing and cleaning of kitchen utensils, and garbage must be disposed of.
6.4. Security deposit
For any stay at the Campsite, a deposit of €150 will be required on the day of arrival for rental accommodations. This deposit can be made by credit card or check. The security deposit will be refunded in full on the day of departure or within fifteen days at the latest, after satisfactory cleaning inspection and equipment assessment. Otherwise, the security deposit will be withheld in its entirety. Damages exceeding the amount of the security deposit will be the responsibility of the client, after deducting the security deposit. If the client has provided a cash security deposit and wishes to immediately receive the amount after departure, they must make an appointment no later than the day before departure to conduct an inventory of their accommodation.
6.5. Cancellation/interruption insurance
The Campsite offers optional paid Cancellation and Interruption Insurance through its partner, Gritchen Tolède & Associés - Insurance Brokerage Company HEADQUARTERS: 27 Rue Charles Durand - CS 70139 - 18021 BOURGES Cedex – France.
It is not refundable in case of cancellation. The full guarantees are detailed in the Insurance General Conditions and the Insurance Product Information Document provided before the conclusion of the Contract, as well as on the Camping website.
6.6. Electric Vehicle Charging on the Rented Site
Charging electric vehicles using domestic outlets on the campsite pitches is strictly prohibited. The campsite's electrical installation is dedicated to the proper functioning of the accommodations and facilities and is not suitable for the charging of clients' personal vehicles.
6.7. Optional Equipment
The Campsite offers optional equipment such as baby cots, barbecues, etc. These items are provided upon request and subject to availability. For any inquiries, the Campsite is available at 03 86 30 73 44 (local call rates according to your operator's terms and conditions).
Article 8. Right of Withdrawal
The client is informed that, in accordance with Article L. 121-20-4 of the Consumer Code, the sale of accommodation services provided on a specific date or according to a specific periodicity is not subject to the provisions regarding the right of withdrawal applicable to distance sales. Therefore, no right of withdrawal applies to stays booked at the Campsite. However, this exemption does not apply to any insurance policies taken out (14-day withdrawal period in accordance with legal provisions).
Article 9. Modification of Reservation/Stay
Any request for modification must be made at least 10 days before the start of the stay. It is the client's responsibility to make the request to the Campsite by registered mail with acknowledgment of receipt to the Campsite's address or by sending an email to the following address: info@campinglesbains.com. The Campsite will make every effort to accommodate the request based on availability and applicable rates. If the modification is not possible or accepted, the client must proceed with the stay under the initially planned conditions or cancel it.
Article 10. Cancellation of Stay
10.1 Cancellation by the Campsite
Except in cases of force majeure, the entire stay will be fully refunded. This cancellation shall not, under any circumstances, give rise to the payment of damages and interest.
10.2 Total or Partial Cancellation by the Client
It is the client's responsibility to notify the Campsite by registered mail with acknowledgment of receipt to the Campsite's address or by sending an email with acknowledgment of receipt to the following address: info@campinglesbains.com. The date of receipt of the cancellation will determine any cancellation fees. In the absence of written communication under the aforementioned conditions, the client will be liable for the payment of the full amount due for the reservation.
The applicable cancellation fee scale is as follows:
• No cancellation fee 31 days (or more) before the stay.
• Between the 30th and the 16th day inclusive before the stay: 30% of the total rental amount will be charged.
• Less than 15 days before the stay or in case of no-show: the full amount due for the reservation will be charged.
It is clearly stated that regardless of the chosen cancellation date, any fees associated with the cancellation/interruption insurance are non-refundable.
Article 11. Stay Procedures
11.1 Arrival and Departure Times
Check-in time is from 4:00 PM, and check-out time is between 10:00 AM and noon. If a client is unable to arrive within the designated check-in hours, they must immediately contact the Reception to try to find a solution. In case of a no-show within 24 hours following the scheduled arrival date, and without written communication to the Camping confirming a certain date, the Camping reserves the right to put the accommodation/pitch back up for sale. No refunds or compensation will be provided. No discounts will be given for delayed arrival or early departure.
11.2 Check-in / Check-out
Check-in - Upon arrival, the Reception checks the client's balance. The client must have paid the full balance, present a valid official identification document, and provide the deposit according to the conditions mentioned above. After registering the client's arrival, the Reception will provide the client with the keys to the rental accommodation and relevant information. It is the client's responsibility to check the inventory upon arrival and report any discrepancies on the same day. Check-out - The client must return the accommodation in perfect cleanliness. Otherwise, cleaning fees equivalent to the amount of the cleaning fee package may be deducted. Similarly, any broken, lost, or damaged items during the stay may be charged to the client. The deposit will be refunded according to the conditions mentioned above.
11.3 Internal Regulations
During the stay, the client agrees to comply with the Camping's internal regulations, which are available/posted at the reception and on the Camping's website. These regulations apply to all persons residing with or under the client's responsibility. Unless stated otherwise in the Camping's internal regulations or expressly authorized by the Camping, setting up a tent is prohibited on rental accommodation pitches. In case of blatant non-compliance with these regulations, the Manager may impose sanctions, including contract termination, especially in the case of disruptive behavior contrary to the peace and serenity of the facility, or in case of violent behavior, offensive, racist, or threatening remarks made towards other clients, Camping staff, or its partners or suppliers. The client is informed that access to the accommodation may also be denied.
11.4 Pets

Two pets are allowed per rental accommodation or pitch, provided they are notified at the time of booking or on arrival. Pets are not allowed to roam freely and must be kept on a lead, including on the rented pitch. They are not allowed in the pool area, children's play area or toilet blocks.
Animal faeces must be collected by the Customer and their behaviour must not disturb the peace and quiet of other customers. Customers are asked not to leave their dogs alone. Two conditions must be met before pets are accepted: - valid anti-rabies vaccination - iden-tification by tattoo or chip certified by a card issued by the Société Centrale Canine.
Customers must bring their animal's health record with them. Dangerous or aggressive animals (including 1st and 2nd category dogs) and exotic animals are not accepted.

11.5 Visitors

Any visitor invited by the client must be reported and registered at the Camping Reception. The Camping reserves the right to deny them access to Camping services. The visitor must comply with the Camping's regulations. For any visitor aged 7 and older, staying on the campsite for more than 2 hours, a fee must be paid. The amount is determined according to the current rate. For less than 2 hours, visitors are admitted free of charge to the site but without access to the water park. Their vehicle is prohibited inside the camping area and must remain in the communal parking lot.
Article 12. Liability
Outdoor accommodations do not fall within the framework of hoteliers' liability as provided for in Article 1952 of the Civil Code. Consequently, the Camping's liability cannot be engaged in case of loss, theft, or damage to personal effects, whether in the Camping area, parking lots, or communal facilities (bike storage, sanitary facilities, etc.). It is specified that parking is done at the client's own risk. The client is required to take out liability insurance and, if necessary, contact their regular insurance company to extend the coverage of their home multi-risk insurance to the occupied accommodation for the duration of the stay. The Company has an obligation of means for all steps of access to the website, the reservation process, and subsequent services. Although the Camping makes its best efforts to maintain an operational service, it cannot guarantee continuous access to its website and therefore declines any responsibility for any direct and/or indirect damages caused by the impossibility of accessing it in whole or in part or that may arise from the use of the service by an internet user. The Camping cannot be held criminally or civilly liable for the consequences resulting from inappropriate or unauthorized use of the website or its content by users or any other third party. The Camping cannot be held responsible for the communication by any third party of photographs for which they have declared to have the rights, false, misleading, or incorrect information that may be mentioned in catalogs or on websites concerning the Camping, including presentation photos, qualifications, activities, leisure, services, and operating dates. The Camping cannot be held responsible for the non-performance or improper performance of the contract, in case of client's fault, force majeure, or unforeseeable and insurmountable act of a third party unrelated to the provision of services under the contract. In any case, if the Camping were held responsible for any cause, any possible compensation would be limited to the amount of the stay.

Article 13. Complaints

Any complaint must be reported by the client during their stay at the Camping so that the Camping can remedy or observe the non-compliance. If the non-compliance cannot be resolved on-site, the client may submit a written complaint to the Camping for them to attempt to address it. In order to best study the complaint, the client is requested to provide, as soon as possible, all factual elements (photographs, videos, notably) that they can gather unless the non-compliance was observed on-site by the Camping. Any complaint regarding the client's stay must be sent by mail to the Camping's address or by email to info@campinglesbains.com. No complaint can be considered for an incident that has not been reported to the Camping Manager during the stay.
Article 14. Protection of personal data
14.1 Data collection
When browsing our website, information is collected about our clients.
There are three categories of information:
• Information provided by the client during a reservation request: names, first names, and dates of birth of all participants, postal address, email address, phone number. • Information collected automatically: cookies (see cookie usage policy). • Information collected from third parties.
All of this information is considered confidential by the Company. It is used solely by the internal services of the Camping for processing the client's request and to enhance and personalize communication and service offerings reserved for clients.

Article 15. Image rights authorization
During their stay, the client and the persons staying with them (hereinafter referred to as the Guests) may be photographed or filmed within the Camping as part of group shots (hereinafter referred to as the Images), which the client accepts on their behalf and on behalf of the Guests. The client also authorizes, on their behalf and on behalf of the Guests, the Camping to publish the Images on their social networks for a maximum period of 5 years from the acceptance of these General Sales Conditions. In any case, it is understood that the client and the Guests:
•may revoke the above authorizations by indicating so in writing to the Camping reception during their stay;
•may request the deletion of the Images concerning them on social networks by sending an email to the following address: info@campinglesbains.com
•will not receive any remuneration for the dissemination of the Images as provided for in this Article 15.

Article 16. Applicable law, jurisdiction, and mediation

These General Sales Conditions are subject to French law, and any dispute relating to their application falls within the jurisdiction of the courts, regardless of the client's country of origin. In the event of a complaint and after contacting the Camping's Customer Service in accordance with the Complaint procedure, the client has the possibility to contact a consumer mediator within a maximum period of one year from the date of the written complaint sent by registered mail with acknowledgment of receipt to the operator. In accordance with the provisions of Article 1368 of the Civil Code, it is expressly agreed that the data stored in the Company's information system and/or its partners have evidentiary value. Thus, data stored on computer or electronic media, if produced as evidence by the Company in any legal or other proceedings, shall be admissible, valid, and binding between the parties.
Article 17. Partial invalidity of the General Sales Conditions
In the event that one of the clauses of these General Sales Conditions is declared null and void due to a change in legislation, regulations, or a court decision, this shall in no way affect the validity and compliance of these General Sales Conditions.
